Conveyancing & Residential Property: Why You Need a Solicitor If you're planning on buying or selling a property, you'll need to engage the services of a solicitor. But what exactly does a solicitor do? In short, a solicitor is responsible for ensuring that the legal transfer of ownership of a property is carried out smoothly and efficiently. Here's a more detailed look at what solicitors do when it comes to conveyancing and residential property. Conveyancing is the process of transferring the legal title of a property from one person to another. In England and Wales, this process must be carried out by a qualified solicitor. The first step in the conveyancing process is for the solicitor to check that the seller is the rightful owner of the property and that there are no outstanding mortgages or other charges on the property. The next step is for the solicitor to prepare all of the legal documents required for the sale, such as the contract of sale, transfer deed, and mortgage deed (if applicable). Once all of the paperwork has been finalised, both the buyer and seller will need to sign it. The buyer will also need to pay any Stamp Duty Land Tax that is due on the purchase price of the property. Once all of these steps have been completed, the keys to the property can be handed over to the buyer. It's important to note that buyers and sellers can use different solicitors if they wish; however, it's often more convenient (and cheaper) to use just one solicitor who can act on behalf of both parties.
